overview

What is this hack?

Brands deduct 10% TDS on payments, but actual tax liability often lower (especially under Section 44ADA). File ITR to claim refund of excess TDS and recover blocked cash within 3-6 months

how it works

How it works

When brands pay content creators for sponsorships, collaborations, or brand deals, they are required to deduct 10% TDS (Tax Deducted at Source) under Section 194J if payment exceeds ₹50,000. However, your actual tax liability after claiming deductions and applying presumptive taxation (Section 44ADA at 50% expenses) is often much lower than 10%. For example, if you receive ₹20 lakh in brand payments, brands deduct ₹2 lakh as TDS. But if you're using Section 44ADA, only ₹10 lakh (50%) is taxable. At the current new-regime slabs the tax on ₹10 lakh is ₹40,000, and the Section 87A rebate (up to ₹60,000 where total income does not exceed ₹12 lakh) removes it entirely - your actual tax is nil. The whole ₹2 lakh is stuck with the Income Tax Department until you file your ITR and claim a refund. Most creators don't realize this refund is available, or they don't file ITR properly to claim it. The refund process takes 3-6 months typically, but it's YOUR money that deserves to be recovered. This hack becomes especially valuable as your brand deal income grows - the refund amounts can be substantial (₹50K to ₹5L or more annually).

steps

Step-by-step guide

01 ·

Collect Form 16A from All Brands

After each brand payment, request Form 16A - a TDS certificate showing how much tax was deducted. Brands must issue this within 15 days of depositing TDS. Keep all Form 16A certificates organized by financial year. These prove TDS was deducted on your behalf.

02 ·

Reconcile TDS in Form 26AS

Login to Income Tax e-filing portal and download Form 26AS (Annual Tax Statement). This shows all TDS deducted by various brands on your PAN. Cross-verify Form 26AS entries with your Form 16A certificates. If any TDS is missing in 26AS, contact the brand immediately - they may not have deposited TDS properly. Only TDS shown in 26AS can be claimed as credit.

03 ·

Calculate Your Actual Tax Liability

Use our Creator Income Tax Calculator to compute exact tax: Total brand income received, Apply Section 44ADA (50% presumptive expenses) if eligible, Calculate tax on remaining 50% income using income tax slabs, Deduct 80C/80D and other eligible deductions (available only if you opt out of the default new regime), Compare actual tax with total TDS deducted - the difference is your refund amount.

04 ·

File ITR-4 (if 44ADA) or ITR-3 (if books maintained)

File your Income Tax Return by July 31 deadline (for income earned in previous FY). If using Section 44ADA: File ITR-4, declare total professional income, opt for presumptive taxation at 50%, If maintaining books: File ITR-3, declare income and claim actual expenses. In both cases, enter TDS details from Form 26AS - this auto-fills in ITR.

05 ·

Claim Refund in ITR

After entering all income, deductions, and TDS details, ITR will auto-calculate if you have excess TDS. The "Refund" section will show the amount you'll receive back. Verify your bank account is pre-validated in e-filing portal (for direct refund credit). Submit ITR with digital signature or Aadhaar OTP. Download and keep ITR acknowledgment (ITR-V) for records.

06 ·

Track Refund Status

Login to e-filing portal → My Account → Refund/Demand Status. Typical timeline: ITR filed → Processed in 15-30 days → Refund approved → Credited to bank in 30-90 days. You can also check status via NSDL website or by calling IT helpline. Refunds are credited directly to your bank account via NEFT. If refund is delayed beyond 3 months, file a grievance on e-filing portal.

example

Real Example: YouTuber with ₹20L Brand Sponsorship Income

scenario

situation

Priya is a lifestyle YouTuber who earned ₹20 lakh from brand sponsorships in a year. Brands deducted 10% TDS = ₹2 lakh across 8 different brand deals. She has no other major income. She uses Section 44ADA presumptive taxation (50% expenses).

without this hack

Priya doesn't file ITR thinking "brands already deducted tax, I'm done". Result: ₹2 lakh TDS remains with IT Department forever. She paid much more tax than required. No refund, no benefit. Total effective tax rate: 10% of gross income.

with this hack

Priya files ITR-4 after the year ends: Total income: ₹20L. Section 44ADA: 50% expenses = ₹10L. Taxable income: ₹10L. Tax calculation at the current new-regime slabs (assuming she has no other income): Up to ₹4L: NIL (basic exemption). ₹4L-₹8L: 5% = ₹20K. ₹8L-₹10L: 10% = ₹20K. Total ₹40K, wiped out by the Section 87A rebate (available up to ₹12L of total income). Total tax: NIL. TDS already paid: ₹2 lakh. Refund due: the full ₹2 lakh. Refund credited to bank in 3 months. Effective tax rate: nil instead of 10%.

₹2 lakh refund recovered by filing ITR properly
common pitfalls to avoid
  • Must file ITR on time (by July 31) - late filing can delay or reduce refund with interest penalty
  • Need all Form 16A certificates - if brand didn't provide, get from them or check 26AS
  • Refund timeline unpredictable - can take 3-6 months, sometimes up to 12 months in backlog
  • If TDS not reflected in Form 26AS, you won't get refund - brands must deposit TDS properly
  • Don't inflate expenses or claim false deductions to get bigger refund - risk of scrutiny and penalty
  • If you have multiple income sources, refund calculation becomes complex - consult CA
